Legal Highlights: Daniel Radcliffe went to Canada during a time when he was transitioning from a P-2 Visa to an O-1 Visa (for more flexibility and a longer stay). Although he had been approved for the O-1 Visa he hadn't gotten the physical visa stamp, because if you don't leave the US you don't actually need one (provided you changed status while in the US). However, if you leave the US and try to re-enter, you will need a visa stamp. Many people leave the country and go to either Mexico, Canada, or their home country to get their visa stamp at a US Consulate. For reasons that are the subject of a current White House Petition, you cannot get your visa stamped inside the US. For unknown reasons this article is pointing to "the computers being down" as the reason he was not allowed back in. However, if the first part of the article was correct, and his visa wasn't stamped, computers or not he would not have been allowed back in. I am assuming that his public relations people advanced that story to limit his 'negligence' in the matter. The lesson my clients need to learn from this is if you are leaving the country, even just to Canada, let your Attorney know. It's better to be safe than sorry.


Full Text: In any of the Harry Potter movies which made him famous, it would have taken little more than a wave of his magic wand. Daniel Radcliffe had apparently failed to upgrade his visa, but even the man who played the world's best-known wizard couldn't beat the US border guards.

Daniel Radcliffe was stopped by officials as he tried to cross over the border from Canada to the US on Thursday after apparently failing to upgrade his visa. The Briton had been in Toronto to attend the premiere of "What If" with co-star Zoe Karan and to celebrate his 25th birthday on Wednesday. According to US reports, he was in the process of upgrading his P-2 visa - for foreign actors and entertainers - to an O-1 visa for 'the individual who possesses extraordinary ability in the sciences, arts, education, business or athletics'. An O-1 grants the holder a three-year stay in the US, while the P-2 only gives a performer residency for the time they are working on a project, not to exceed a year. His spokesman told the New York Post that Radcliffe had been approved for the upgrade but needed a "stamp from the US embassy" in Toronto and their "computer was down".

Radcliffe had been due to attend his first Comic-Con in San Diego to promote another darker film "Horns", a Halloween thriller which sees his character growing horns on his head after the mysterious death of his girlfriend. According to Radcliffe's spokesman, the star did eventually get to San Diego, just in time to appear on a Comic-Con panel this afternoon with Horns co-star Juno Temple and director Alexandre Aja.

The visa fiasco comes days after the actor tried to distance himself from the childhood role that made him a household name by opening up about his sex life. He claimed he was 'better' than ever in the bedroom department after losing his virginity, and prefers to remain sober. He told The Daily Star: "I'm one of the few people who seem to have had a really good first time. It was with somebody I'd gotten to know well. I'm happy to say I've had a lot better sex since then. But it wasn't as horrendously embarrassing as a lot of other people's were, like my friend who got drunk and did it with a stranger under a bridge."

Radcliffe quit drinking four years ago after admitting his alcohol addiction had grown out of control and deciding to clean up his act for the sake of his career. "For some people sex might be better drunk. But for me and the person I'm doing it with it's much better sober," he added.

The Woman in Black star went public in April with girlfriend Erin Darke - who he met on the set of Kill Your Darlings in 2012. He previously dated production assistant Rosie Coker who he met on the set of the sixth Harry Potter flick, The Half-Blood Price.
